Terms of Service

Please read these Terms carefully before using NillarPay. By creating an account or using our services, you agree to be bound by these Terms.

1. Introduction and Agreement

These Terms of Service ("Terms") govern your access to and use of the NillarPay platform, including our mobile application, website at pay.nillar.com, and all related services (collectively, the "Services"), operated by Nillar Technology Limited("Nillar", "we", "us", or "our"), a company incorporated in Nigeria with RC Number RC 9432737.

By downloading our app, visiting our website, creating an account, or using any of our Services, you ("User", "you", or "your") agree to these Terms and our Privacy Policy. If you do not agree, please do not use NillarPay.

Important Notice: NillarPay is a technology platform — NOT a bank. Banking and financial services (including wallet accounts and bank transfers) are provided through our licensed banking partners, including Anchor. Your funds are held and managed by our regulated banking partners in accordance with applicable Nigerian banking regulations.

2. Eligibility Requirements

To use NillarPay, you must meet all of the following requirements:

  • You must be at least 18 (eighteen) years of age.
  • You must be a Nigerian resident or a Nigerian citizen with a valid Nigerian phone number.
  • You must have a valid Bank Verification Number (BVN) or National Identification Number (NIN) for identity verification.
  • You must have the legal capacity to enter into a binding contract under Nigerian law.
  • You must not have been previously suspended or banned from using NillarPay or any of our partner services.
  • You must not be subject to any Nigerian or international sanctions, money laundering investigations, or terrorism-financing designations.
  • You must use the Services only for lawful purposes and in compliance with these Terms.

By registering, you confirm that you meet all eligibility requirements and that the information you provide is true, accurate, and complete. We reserve the right to request additional verification at any time.

3. Account Registration

3.1 Creating Your Account

To access NillarPay Services, you must create an account by providing your full legal name, phone number, email address, date of birth, and any other information we reasonably request during the registration process.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials, including your PIN, password, and One-Time Passwords (OTPs). You agree to:

  • Never share your PIN, password, or OTP with any third party, including persons claiming to be NillarPay staff.
  • Immediately notify us at support@nillar.com if you suspect unauthorized access to your account.
  • Lock your device if it contains an active NillarPay session.
  • Use only the official NillarPay application downloaded from authorised app stores.

3.3 One Account Per Person

Each individual may only maintain one (1) personal NillarPay account. Creating multiple accounts or allowing another person to use your account is prohibited and may result in suspension.

3.4 Accurate Information

You must provide accurate and up-to-date information at all times. If your details change (e.g., phone number, address), you must update your account promptly. Providing false or misleading information is a violation of these Terms and may be a criminal offence under Nigerian law.

4. Know Your Customer (KYC) Requirements

To comply with Nigerian financial regulations, including the Central Bank of Nigeria (CBN) Know Your Customer (KYC) guidelines and the Money Laundering (Prevention and Prohibition) Act, we are required to verify your identity before providing full access to our Services.

4.1 Verification Tiers

NillarPay operates a tiered KYC system:

  • Tier 1 (Basic): Phone number verification — limited transaction limits apply.
  • Tier 2 (Standard): BVN or NIN verification — standard transaction limits apply.
  • Tier 3 (Enhanced): Government-issued ID (Passport, Driver's Licence, Voter's Card) plus selfie verification — higher transaction limits and full feature access.

4.2 Verification Process

KYC verification is conducted through government-approved identity verification providers integrated within the NillarPay platform. By submitting your BVN or NIN, you consent to us verifying your identity with the Nigeria Inter-Bank Settlement System (NIBSS) and the National Identity Management Commission (NIMC) or their authorised agents.

4.3 Ongoing Verification

We may request additional documents or information at any time to maintain compliance with applicable regulations. Failure to provide requested information may result in restriction of your account pending resolution.

NillarPay will NEVER ask for your BVN or NIN through phone calls, SMS, WhatsApp, or email. Only submit these details through the official NillarPay app or website.

5. Wallet Usage Rules

5.1 Nature of Wallet

Your NillarPay wallet is a digital payment account maintained by our licensed banking partners. Funds in your wallet are not deposits with Nillar Technology Limited but are held by our banking partners in accordance with CBN regulations.

5.2 Permitted Uses

You may use your NillarPay wallet to:

  • Receive money from other NillarPay users or bank accounts.
  • Send money to other NillarPay users or any Nigerian bank account via the NIP (NIBSS Instant Payment) system.
  • Purchase airtime and data bundles for any Nigerian network.
  • Pay utility bills (electricity, water, cable TV, etc.).
  • Make payments to supported merchants.
  • Fund your wallet from any Nigerian bank account.
  • Withdraw funds to your linked Nigerian bank account.

5.3 Transaction Limits

Transaction limits apply based on your KYC tier as prescribed by CBN guidelines. These limits may be updated from time to time. Current limits are displayed within the NillarPay application.

5.4 Dormant Accounts

An account with no transactions for twelve (12) consecutive months may be classified as dormant. We will notify you before taking any action on dormant accounts, in line with CBN guidelines on dormant accounts.

6. Prohibited Activities

You may not use NillarPay for any of the following purposes. Violation may result in immediate account suspension and reporting to relevant authorities:

6.1 Illegal Activities

  • Fraud, money laundering, or financing of terrorism.
  • Receiving or sending proceeds of crime.
  • Operating a Ponzi or pyramid scheme.
  • Impersonating another person or entity.
  • Tax evasion or any other financial crime.

6.2 Unauthorised Services

  • Cryptocurrency transactions or exchanges of any kind.
  • International money transfers or remittances.
  • Gambling or lottery payments.
  • Lending, investment, or wealth management services.
  • Processing payments on behalf of unlicensed businesses.

6.3 Platform Abuse

  • Using automated bots, scripts, or tools to access or interact with NillarPay.
  • Attempting to reverse-engineer, hack, or gain unauthorised access to any system.
  • Creating multiple accounts to circumvent transaction limits or verification requirements.
  • Exploiting referral programs in bad faith or in a manner not intended by NillarPay.
  • Submitting false or fabricated documents during KYC or dispute processes.
NillarPay does NOT support cryptocurrency, international remittances, loans, investment products, or gambling. Any attempt to use our platform for these purposes will result in account suspension and may be reported to the EFCC, CBN, or other relevant authorities.

7. Transfers and Payment Authorization

7.1 Transaction Authorization

By initiating a transfer or payment on NillarPay, you authorise Nillar Technology Limited and our banking partners to execute the transaction on your behalf. Your PIN, biometric authentication, or OTP confirmation constitutes your electronic authorisation.

7.2 Irreversibility of Transactions

Transactions processed through the NIP system and other payment networks are generally irreversible once confirmed. Please verify all recipient details (account number and bank name) carefully before authorising any transfer. NillarPay is not liable for funds sent to incorrect account details provided by you.

7.3 Failed Transactions

If a transaction fails after your wallet has been debited, we will attempt to reverse the funds to your wallet within 24–72 hours in accordance with CBN guidelines. If a reversal is delayed, please contact our support team.

7.4 Transaction Records

Your transaction history is available within the NillarPay app and serves as the primary record of your account activity. You should regularly review your transaction history and report any unauthorised transactions within 7 days of the transaction date.

8. User Responsibilities

  • Ensure your device is protected with a strong password, PIN, or biometric lock.
  • Keep your NillarPay PIN private and change it regularly.
  • Log out of the NillarPay app when using a shared device.
  • Not share your account with anyone, including family members.
  • Report any suspected fraud or unauthorised transaction immediately.
  • Ensure you have sufficient funds before initiating a transaction.
  • Comply with all applicable Nigerian laws and regulations when using our Services.
  • Notify us promptly of changes to your personal information, especially your phone number.

9. Fees and Charges

NillarPay may charge fees for certain transactions and services. All applicable fees will be clearly disclosed to you within the application before you confirm any transaction. You will not be charged any fee that was not disclosed to you in advance.

9.1 Types of Fees

  • Transfer fees: Fees may apply to bank transfers sent outside of NillarPay.
  • Airtime/Data convenience fees: A service fee may apply to airtime and data purchases.
  • Bill payment fees: Certain utility bill payments may attract a processing fee.
  • Withdrawal fees: Fees may apply when withdrawing funds to an external bank account.

9.2 Fee Changes

We reserve the right to change our fee structure with at least 7 (seven) days' prior notice communicated via the NillarPay app, email, or SMS. Continued use of the Services after the effective date of a fee change constitutes acceptance of the new fees.

9.3 Third-Party Charges

Certain transactions may attract charges imposed by third-party networks (such as NIBSS transaction fees) that are separate from NillarPay fees. These will be displayed before transaction confirmation.

10. Suspension and Termination

10.1 Our Right to Suspend or Terminate

We may suspend or terminate your account, with or without prior notice, if:

  • You violate any provision of these Terms.
  • We suspect fraud, money laundering, or any illegal activity on your account.
  • We are required to do so by a regulatory authority or court order.
  • You provide false or misleading information during registration or KYC.
  • Your account is used for prohibited activities listed in Section 6.
  • We discontinue the Services (with reasonable notice).

10.2 Your Right to Close Your Account

You may close your NillarPay account at any time by contacting our support team. Before closure, all pending transactions must be completed and any remaining balance must be withdrawn to a linked bank account.

10.3 Effect of Termination

Upon termination, your access to NillarPay Services will cease. Sections relating to intellectual property, limitation of liability, indemnification, and governing law will survive termination.

11. Limitation of Liability

To the fullest extent permitted by applicable Nigerian law, Nillar Technology Limited, its directors, officers, employees, agents, and banking partners shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages.
  • Loss of profits, revenue, data, goodwill, or business opportunities.
  • Losses arising from your failure to safeguard your account credentials.
  • Losses arising from transactions you authorised, including transfers to incorrect accounts.
  • Service interruptions caused by third-party network failures, regulatory actions, or force majeure events.
  • Actions of third-party merchants or service providers.
  • Losses arising from unauthorised access to your account through no fault of ours.

Our total liability to you for any claim arising from or related to these Terms or the Services shall not exceed the total fees paid by you to NillarPay in the three (3) months preceding the event giving rise to the claim.

Nothing in this clause limits our liability for fraud or gross negligence on our part, or for any liability that cannot be excluded under Nigerian law.

12. Indemnification

You agree to defend, indemnify, and hold harmless Nillar Technology Limited, its affiliates, banking partners, directors, officers, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to:

  • Your violation of these Terms.
  • Your use or misuse of NillarPay Services.
  • Your violation of any applicable law or regulation.
  • Any third-party claim arising from your actions on the platform.
  • Inaccurate or false information provided during registration or KYC.

13. Intellectual Property

All content, design elements, trademarks, logos, software, and technology incorporated in the NillarPay platform (collectively, "Intellectual Property") are owned by or licensed to Nillar Technology Limited. You are granted a limited, non-exclusive, non-transferable licence to use the NillarPay application for personal, non-commercial purposes only.

You must not copy, reproduce, modify, distribute, reverse-engineer, or create derivative works from any part of our Intellectual Property without our prior written consent. The NillarPay name, logo, and brand are registered trademarks of Nillar Technology Limited.

14. Amendments to Terms

We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices. We will notify you of material changes through:

  • A push notification via the NillarPay app.
  • An in-app banner or pop-up notification.
  • An email to your registered email address.
  • An SMS to your registered phone number.

Updated Terms will be effective 7 (seven) days after notification for material changes, or immediately for minor clarifications. Your continued use of NillarPay after the effective date constitutes your acceptance of the revised Terms.

15. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria, including but not limited to:

  • The Central Bank of Nigeria Act and CBN regulations.
  • The Money Laundering (Prevention and Prohibition) Act, 2022.
  • The Nigeria Data Protection Act (NDPA), 2023.
  • The Companies and Allied Matters Act (CAMA), 2020.
  • The Consumer Protection Council Act.

15.1 Dispute Resolution

In the event of a dispute, you should first contact NillarPay through our official support channels. If the dispute is not resolved within 30 days, either party may escalate to the Consumer Protection Department of the CBN, the Federal Competition and Consumer Protection Commission (FCCPC), or seek resolution through the courts of the Federal Capital Territory, Abuja, Nigeria.
